9.3 Cap on Liability

Our total liability for any claims arising out of or relating to these terms or our services is limited to the amount you paid us to use our services in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Niblin and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our Services shall be resolved through binding arbitration conducted in Mumbai, Maharashtra in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding.

14. Returns and Refunds Policy

14.1 7-Day Free Trial

We offer a 7-day free trial for new customers. You may cancel your trial at any time during this period without any charges. If you do not cancel before the trial ends, you will be automatically charged for your selected subscription plan.

14.2 Subscription Services

After the trial period, all subscription fees are generally non-refundable. However, we may consider refund requests on a case-by-case basis under the following circumstances:

• Technical issues that prevent you from accessing our Services for an extended period
• Duplicate charges or billing errors

If refund approved, amount will be credited to your source account within 7-10 business days.

14.3 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting support@niblin.com. Upon cancellation, you will retain access to the Services until the end of your current billing period. No refunds will be provided for the remaining time in your billing cycle.
